Terms and Conditions

§ 1 Scope and subject matter

These terms apply to all contracts between the operator of UrbanBoost ("Provider") and consumers/business customers ("Customer") for digital content (especially firmware/software files) for e-scooters via the online shop. The subject matter is solely provision of the digital file or its creation on commission – not delivery of a vehicle, not installation services and not road legal approval.

§ 2 Permitted use

Files are intended exclusively for use on private property without public road traffic. Use on public roads or similar public areas is prohibited. The customer warrants lawful use, authority to modify the vehicle and compliance with all applicable laws.

§ 3 Contract formation

Shop display is not a binding offer. By completing PayPal payment and required checkboxes the customer makes a binding offer; the contract is formed when the Provider accepts by starting provision/creation. For custom orders, delivery times vary; no fixed date is guaranteed.

§ 4 Prices and payment

Prices shown at checkout in EUR. Payment via PayPal only. Customer bears any payment provider fees where applicable.

§ 5 Digital delivery and withdrawal

Digital content is delivered by email (download link or notice). For instant delivery the Provider begins performance immediately. The customer expressly agrees to early performance and loss of the right of withdrawal once performance is complete where applicable by law.

§ 6 No success or approval guarantee

No guarantee of any specific speed, fault-free operation or continued road approval. Model and km/h information is descriptive only; technical deviations are possible.

§ 7 Customer duties and risks

Installation and flashing are at the customer's own risk. The customer is responsible for backups, compatibility, safety and insurance. Damage to persons or property from use is borne by the customer where permitted by law.

§ 8 Limitation of liability

Unlimited liability only for intent, gross negligence and injury to life, body or health. Otherwise liability for breach of cardinal duties is limited to foreseeable typical damage. Further liability – especially for public road use, fines, insurance exclusions or indirect damage – is excluded where permitted by law.

§ 9 Indemnity

The customer indemnifies the Provider against third-party claims arising from unlawful or contractual breach of use, customer installation or breach of these terms, including reasonable defence costs.

§ 10 Warranty

Statutory warranty for digital products applies, subject to the liability limits above. Custom orders: best-effort creation, not a guaranteed measurable outcome.

§ 11 Licence

Simple, non-transferable licence for personal use under these terms. Redistribution, resale or publication of files is prohibited.

§ 12 Final provisions

German law applies, excluding CISG. Mandatory consumer protection of the customer's residence remains unaffected. If individual clauses are invalid, the remainder stays effective.
